Rather, the court held that the applicant had to prove one of the following arguments: (1) the question asked is “questionable among the lawyers of reason”, (2) a court could resolve the issue in another way, or (3) the question merits further proceedings. In 1996, a federal law was enacted to require a Certificate of Appeal (COA) in both cases.
